APPLICANT REQUESTS THAT:
His records be corrected to reflect his overseas duty and his
awards and decorations.

APPLICANT CONTENDS THAT:
His DD Form 214, Armed Forces of the United States Report of
Transfer or Discharge, does not reflect his overseas service in
the Republic of Korea or any of the awards and decorations he
earned from said service.

STATEMENT OF FACTS:
The applicants military personnel records were apparently
located in the area most heavily damaged in the fire at the
National Personnel Records Center in 1973. Documents provided
by the applicant indicate that he enlisted in the Regular Air
Force on 16 June 1954 and served on active duty until he was
honorably discharged on 6 December 1957 and credited with
3 years, 5 months, and 21 days of total active service.
On 23 March 2007, the applicant was notified that his records
were likely destroyed in the aforementioned fire at NPRC and
asked to provide copies of any documents in his possession that
could be helpful in adjudicating his instant request.

AIR FORCE EVALUATION:
AFPC/DPSID recommends denial, indicating there is insufficient
documentation to verify the applicants eligibility for Korean
service awards. The Korean Defense Service Medal (KDSM) is
awarded to service members who have been permanently assigned,
attached, or detailed to a unit that operated within the area of
eligibility and must have been physically deployed in the area
if eligibility for 30 consecutive or 60 non-consecutive days;
however, there is insufficient documentation to verify applicant
was in the area of eligibility for Korean service awards.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the
applicant on 14 December 2012, for review and comment within 30
days (Exhibit D). As of this date, this office has received no
response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was not timely filed; however it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of an error or injustice. We took
notice of the applicants complete submission in judging the
merits of the case; however, we agree with the opinion and
recommendation of the Air Force office of primary responsibility
(OPR) and adopt its rationale as the basis for our conclusion
the applicant has not been the victim or an error or injustice.
Therefore, in the absence of evidence to the contrary, we find
no basis to recommend granting the relief sough in this
application.

THE BOARD DETERMINES THAT:
The applicant be notified the evidence presented did not
demonstrate the existence of material error or injustice; the
application was denied without a personal appearance; and the
application will only be reconsidered upon the submission of
newly discovered relevant evidence not considered with this
application.
